Definitions

Company: means Pestalia SRL, registered office at Via Giuseppe Fanelli, 238 – 70125 – Bari (BA), registered in the Bari Companies Register (VAT number 08293540723), owner of the domain name of this Site and operator of the e-commerce platform operating on the Site, accessible through the same.

Seller: means the third-party legal entity independent of the Company, clearly identified on the Site and the Platform, which uses the Site and the domain name granted to it by the Company, and which offers the Goods for sale to the public via the Platform itself.

The Seller, therefore, is solely responsible for the correct execution of the sale of the Goods to the Customer, and has declared that he is the legitimate owner of the Goods offered for sale, that they comply with current Italian and European legislation, and that he is authorised to carry out e-commerce activities.

Site: means this website on which the Platform operates.

Contract: means the sales contract relating to a Good, which the Customer concludes directly with the Seller by placing the Order, communicating its acceptance by the Seller and paying the relevant price.

Consumer Code (Consumer Code): means the D.Lgs. 6/9/2005, n. 206.

General Conditions of Sale (GTC): means these contractual conditions, published on this Site, which the Customer can view and print a copy of at any time, which concern the sale of the Goods by the Seller to the Customer.

Every purchase of Goods made through this Site and the e-commerce platform is governed by this document and constitutes a distance selling pursuant to Articles 51 et seq. of the Consumer Code.

Purchase Voucher or Coupon: means a legitimation document that can be purchased by the Customer on the Site via the Platform and downloaded and saved in electronic form and/or printed in paper form, equipped with a unique identification code, which gives the Customer, for a maximum period of 90 (ninety) days from the purchase, the right to purchase goods or use services of his choice at the physical location or store of the Seller, for a value indicated on the voucher itself.

Procedure for purchasing the goods

The process of purchasing a good consists of the following steps:

2.1. The Order form will indicate in detail, in a clear and easily understandable manner, before its confirmation by the Customer:

a) the essential characteristics of the Goods put up for sale by the Seller via the Platform;

b) the identification data and physical contact details of the Seller (in the case of a sole proprietorship, firm; in the case of a company, business name or name; physical address of the main office and/or any secondary offices; telephone numbers; email address);

c) the quantity of the Goods which are the object of the Order;

d) the total price of the Goods (including all applicable taxes and duties);

e) the costs of delivery of the Goods (with any additional costs);

f) the methods, address and delivery of the Goods;

g) the request for the Customer to read and accept the General Conditions of Sale;

h) the request to read and accept the conditions established for the exercise of the right of withdrawal by the Customer, as well as the methods, costs and times for returning the Goods and the related refund of the Price already paid (where applicable);

i) any request for issuing a commercial invoice;

l) the total price of the Order (including taxes, duties and shipping costs);

m) the payment method chosen by the Customer from among those expressly indicated on the Site and provided for by the Platform;

Once the Order form has been completed, the Customer may, before submitting the Order, print or save it in electronic format.

2.3. Submitting the Order form and paying the price: The Customer will submit the Order form using point-and-click methods, that is, by selecting a virtual button on the Site clearly and legibly displaying the words "order and pay", or by any other similar action involving the explicit recognition by the Customer of the fact that submitting the Order implies the obligation on his/her part to pay the price.

Payment of the total price of the Order is an essential condition for the Contract to be considered concluded and the order to be processed.

Once the Order has been submitted and the Price has been paid, the Customer will receive, within the strictly necessary technical timeframe, an email confirming the Seller's acceptance of the Order and payment of the price, containing a summary of the contents of the Order itself.

2.4. Conclusion of the Contract: the contract between the Customer and the Seller will be deemed concluded upon receipt by the Customer of the communication of acceptance of the Order by the Seller and payment of the relevant price.

2.5. Order Storage: The Order form will be stored in the Platform's database for the period of time necessary to execute it and in any case within the legal deadlines.

2.6. Refusal to fulfill the Order and refund of the Price: The Seller may refrain from fulfilling the Order placed by the Customer if the identification data entered by the Customer in the Order form is incomplete or incorrect. Should this occur, the Customer will be informed, within the strictly necessary technical timeframe, by email, of the reasons for the failure to complete the Contract and will receive a full refund of any Price already paid.

2.7. Unavailability of the Goods: If, for any reason, the Goods are no longer available from the Seller, the Seller may temporarily suspend the fulfillment of the Order by contacting the Customer by email within 5 (five) working days of submitting the Order form. The Seller will provide the Customer with all information regarding the expected restocking and delivery times of the Goods and may also offer the Customer a Good with equivalent characteristics and value to replace the unavailable Goods.

In this case, the Customer has the right to withdraw from the contract and cancel the Order, rejecting any alternative proposal received from the Seller. If payment has already been made, the Customer will receive a full refund of the sums paid according to the established times and methods.

Payment Methods

Accepted payment methods are credit card, PayPal, and bank transfer.

Credit cards: Visa, MasterCard, American Express, prepaid credit cards. The amount will be charged to your card at the time of purchase.

Bank transfer: Upon order confirmation, the Customer will receive all the Seller's banking information necessary to process the payment. Right of withdrawal

The only costs borne by the Customer are those of returning (shipping the products to the seller) the purchased products, unless the Seller has expressly exempted him/her from such costs at the time of purchase. d.the returned products must be delivered to the carrier within fourteen (14) days from when the decision to withdraw from the contract was communicated to the Seller;

If the Right of Withdrawal is exercised according to the methods and terms indicated above, the Seller will refund any sums already received for the purchase of the products according to the methods and terms provided. The sums will be refunded as quickly as possible and in any case, within fourteen (14) days from the date on which the Seller received the product, always after the Seller has verified the correct execution of the terms and conditions indicated above. If the methods and terms for exercising the right of withdrawal, below, are not respected, the Customer will not be entitled to a refund of the sums already paid to the Seller. Within fourteen (14) days of sending the email communicating the non-acceptance of the return, the Customer may choose to obtain, at his own expense, the products in the condition in which they were returned to the Seller, by notifying the Seller himself, according to the methods that will be communicated to him. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase. If the above conditions are not met, the Customer will not be entitled to a full refund of the amounts already paid to the Seller. Terms and conditions for return requests:

• The security seal on the items to be returned must not be cut or broken.

• Any damage suffered by the product may give rise to a partial refund

• The item must be complete and in original condition and undamaged, if reasonably possible.

• We may charge a depreciation fee of up to 100% if a product is returned damaged, used or incomplete.

• All items must be returned together with their original box, which is considered an integral part of the product.

Refund times and methods:

After the products are returned, the Seller will carry out the necessary checks to ensure their conformity with the terms and conditions indicated above. If the checks are successful, the Seller will send the Customer, via email, confirmation of acceptance of the returned products. If the checks are unsuccessful, the Seller will notify the Customer, via email, of the decrease in value of the returned products resulting from the Customer's failure to comply with the above conditions. At the same time, the Seller will also communicate the amount that will be deducted from the sums paid by the Customer for the returned products; alternatively, the Customer may have the option of receiving the products back at their own expense in the condition in which they were returned to the Seller, as provided in the previous paragraph. Regardless of the payment method used, the refund, whether full or partial, will be activated by the Seller as quickly as possible and in any case within fourteen (14) days from the date on which the Seller received the returned product, after verifying the correct execution of the right of withdrawal and checking the returned products. The Seller will carry out the refund using the same payment method used by the Customer to purchase the returned products, unless the Customer has expressly agreed with the Seller to use a different payment method and on condition that the Customer does not incur any additional costs as a consequence of the refund. If there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the sums due for their purchase, the refund of the sums, in the event of the exercise of the right of withdrawal, will be carried out by the Seller, in any case, to the person who made the payment.
